Subject: 3 weeks too long to wait for signed contract?

Hi,
I'm in The suburbs of NY and have been waiting for a buyer to sign a contract which I've sent to him over three weeks ago. He called me once and told me he was still interested in the property but still hasn't signed for the specified amount. Can I pull the contract at anytime and sell to someone else without being liable before he signs it? I have signed nothing yet but I did have my lawyer send him the contract. Just want to malke sure he can't sue me . Just sick of waiting around paying a mortgage while other perspective buyers walk away.
